Retro Labs is committed to maintaining the security, confidentiality and privacy of your personal information. This is our Privacy Policy. It documents our ongoing commitment to you and has been developed in compliance with Canada’s privacy laws.

Retro Labs owns, operates and provides various websites and various online or mobile games, products or services (collectively the “Services”). This Privacy Policy applies to our collection, use and disclosure of your personal information in connection with our operation of the Services. Because we gather certain types of information about our users, we want you to understand what information we collect about you, how we collect it, how that information is used, and how you can control our disclosure of it.

This Privacy Policy does not impose any limits on our collection, use or disclosure of business contact information and certain publicly-available information.

You agree that your use of the Services signifies your consent to the collections, uses and disclosures of personal information described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services.

You may withdraw consent at any time, subject to legal, contractual and other restrictions, provided that you give us reasonable notice. When we receive notice of withdrawal of consent, we will inform you of the likely consequences of that withdrawal, which may include our inability to provide certain Services for which that information is necessary.

3. Limits on Collection

We will not collect personal information indiscriminately but will limit collection of personal information to that which is reasonable and necessary. We will also collect personal information as authorized by law.

4. Limits on Using, Disclosing and Retaining Personal information

Your personal information will only be used or disclosed for the purposes set out in this Privacy Policy and as authorized by law. We will keep personal information used to make a decision affecting you for at least one year after using it to make the decision. We will destroy, erase or make anonymous records containing personal information as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the information and retention is no longer necessary for a legal or business purpose. We will take reasonable care when destroying personal information so as to prevent unauthorized access to the information.

5. Information Collected

We collect two types of information from you: (i) information that you voluntarily provide to us (e.g. through a voluntary registration process, sign-ups or emails); and (ii) information that is derived through automated tracking mechanisms.
We may collect information such as your name and e-mail address, any name you use to identify yourself in the Services, details of your use of the Services (including information about when and how you use the Services, traffic data and your geographic location data), and details about your use of social networking and our Services.

• Other Technical Details

We may collect non-personally identifying information of the sort that web browsers and servers typically make available, such as browser type, hardware or mobile device details (including mobile device type and number and mobile carrier details), language preference, referring site, and the date and time of each request. We collect this non-personally identifying information to better understand how our users use our Services and to enhance the Services. We may release aggregate non-personally identifying information from time to time, e.g., by publishing reports on trends in the usage of our sites or products or services.

• Voluntary Registration Information

As described in our Terms of Use, in order to fully access the Services you must first complete the registration process, during which we will collect certain personal information about you. The information will include your name, address, and email address. By registering with us, you consent to the use and method of disclosure as described in this Privacy Policy.

• Voluntary Information for Services and Features

We may also collect personal information when you use certain other features of the Services, including: (i) making purchases, (ii) consenting to receive email or text messages about upcoming promotions or events, (iii) consenting to receive email, (iv) participating in our forum, (iv) commenting on articles, and others. When you choose to use these additional features, we require you to provide your “Contact Information” in addition to other personal information that may be required to complete a transaction such as your phone number, billing and shipping addresses and credit card information. Occasionally, we may also request information such as your shopping preferences and demographics which will help us better serve you and our others users in the future.

• Cookies

We will sometimes use “cookies” and other tracking technologies to allow for an easier user experience for the Services. We may use cookies to help us identify and track visitors, their usage of our Services, and their access preferences.

6. Referrals

You may invite friends to register with Retro Labs by sending invitation emails via invite features in the Services. We store the email addresses you provide so that the respondents may be added to your social network, confirm orders/purchases and also to send reminders of the invitations. We do not sell these email addresses or use them to send any other communication besides invitations and invitation reminders. Recipients of invitations may contact us to request removal of their information from our database.

7. Purposes of Collection, Use and Disclosure

When collecting personal information, we will state the purpose of collection and will provide, on request, contact information for the Privacy Officer who can answer questions about the collection.

We collect, use and disclose your personal information as required or authorized by law and for the following purposes:
• to provide and administer Services, and to disclose the information for any purpose related to operation of accounts and provision of Services;
• to communicate with you through our Services and email;
• to authenticate your identity;
• to monitor your compliance with any of your agreements with us, including the Terms of Use;

• we may share your personal information with suppliers and third parties so that they may offer their products or services to you.
You may tell us to stop using or sharing your personal information in these ways at any time by providing written notification to our Privacy Officer. We acknowledge that the sharing of your personal information in these ways is at your option and we will not refuse you access to any Services merely because you have told us to stop using or sharing your personal information in these ways.
When your personal information is to be used for a purpose not previously identified, the new purpose will be disclosed to you before to such use, and we will seek your consent unless the use is authorized or required by law.
RETRO LABS IS NOT LIABLE OR RESPONSIBLE FOR THE PERSONALLY IDENTIFIABLE OR OTHER INFORMATION YOU CHOOSE TO SUBMIT IN FORUMS SUCH AS A BULLETIN BOARD, CHAT ROOM OR ANY OTHER PUBLICLY ACCESSIBLE PART OF THE SERVICES.

8. How We Protect Your Information

We are committed to protecting the information we receive from you. We take reasonable security measures to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks relating to your personal information, including by maintaining reasonable physical, electronic, contractual and managerial procedures to safeguard and secure the information and data stored on our system. While no computer system is completely secure, we believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of information involved.

9. Accessing and Updating Your Personal Information and Preferences

We will make a reasonable effort to ensure that personal information we are using or disclosing is accurate and complete. We provide mechanisms for updating and correcting your personal information for many of our Services. If you are a registered user, you may access and update your account information and preferences to receive email or other communications through the Services.

You have a right to access your personal information held by Retro Labs. Upon your written request, once we authenticate your identity we will provide you your personal information under our control. We will also give you information about the ways in which that information is being used and a description of the individuals and organizations to whom that information has been disclosed. We may charge you a reasonable fee for doing so.
In some situations Retro Labs may not be able to provide access to certain personal information; we may also be prevented by law from providing access to certain personal information.

10. Email Choice / Opt-Out

You may opt out of e-mail communications from Retro Labs at any time by following the instructions in the emails. In addition, you may send an email to sales@retrolabs.com. We will make reasonable efforts to implement your opt-out requests promptly, but you may still receive communications from us for up to ten business days as we process your request.

11. Push and Local Notifications

We may, with your consent, send push or local notifications to your mobile device to provide Service updates and other relevant messages. You can manage push and local notifications from the Options or Settings section within the relevant Service. You may also be able to manage them from your device’s settings section for the relevant game.

12. Disclaimer Regarding Security of Internet Communications

By consenting to the Terms of Use for the Services and this Privacy Policy, you acknowledge that no data transmission over the Internet is completely secure. We cannot guarantee or warrant the security of any information you provide to us and you transmit such information to us at your own risk.

13. Notification of Changes

Retro Labs reserves the right to change this Privacy Policy from time to time at its sole discretion. If at some point in the future, there is a change to our Privacy Policy, unless we obtain your express consent, such change will only apply to information collected after the revised Privacy Policy took effect. Your continued use of the Services indicates your consent to the Privacy Policy as posted.
